Research Overview It is the obvious intersection of Educational Law, Criminal and Family Law, and my position as a Judge of the Ontario Court of Justice from 1978 until December 2016 that, I believe, has uniquely informed my teaching, research and scholarship at OISE since 1981. Part of my distinctive contribution to OISE is the practical application of these perspectives to the many issues facing educators today. I continue to write and consult in these areas, not only in the context of Journals, as a member of Editorial Board, but also my authorship and co-authorship of textbooks relating in particular to the field of education law. Research has demonstrated that implicit biases influence our perceptions, decisions, actions and behaviors in all realms of social interaction, even though we are not aware of them. "The law,in its majestic equality, forbids rich and poor alike to sleep under bridges, to beg in the streets, and to steal their bread." -Anatole France. As a preventive measure, an ounce of education can be worth a pound of litigation. As is true in many professions, and many less legally intensive than education, educators must understand the legal context in which they operate. Every day, principals and teachers inevitably must make numerous quick judgement calls of potential legal import, often without benefit of legal counsel. There are both economic and educational costs of legal illiteracy. In addition to the financial costs of school litigation, there is the enormous time spent by teachers and administration attempting to avoid or prepare for ultimate litigation. There are so many more lawsuits every year that name principals, teachers - everyone involved. Can I be sued? is always yes.
